Our terms and conditions

Important

Experios Entertainment Pty Ltd (referred to here as “Experios, “our”, “us”, “we”) and the Experios logo are part of Experios Entertainment Pty Ltd (ABN 65 645 829 349). We provide online escape room experiences (Service) with the aim of providing amusement. All dealings with us will be on these terms & conditions (Terms) unless otherwise agreed in writing by us. We reserve the right to make changes at any time. By purchasing and playing Experios Services it is deemed that you understand and accept the Terms outlined on this page.
Please make sure you notify all participants of these Terms.

General

Experios’ Services are played completely online or outdoors.

It is important to understand that for our Services played online, there may be situations where technology might not work as expected. Where possible, we will be trying to help resolve any issues occurring, however customer’s technology are not within our control.
It is advised that all customers have up-to-date anti-virus and malware protection installed on their device. Experios will take all effort to ensure content is safe to visit, however is not liable for any negative effects or damage as a result of using our Services and the content opened.
In case the customer’s (or customer’s company’s) network does not allow access to our online portal or related websites, this is out of our control and the responsibility of the customer. We are not liable for instances where customer’s technology does not allow customer to make use of Experios’ Services.

Booking a live hosted service

Experios offers a corporate Service where an Experios host facilitates your session, including setting up a video call, and provides game codes and portal access.

There may be a minimum number of participants to be able to book this Service.
The Corporate Service requires participants to use Zoom and requires participants to have access to our online portal and related websites.

When making a booking for our Corporate Service, a deposit may be required.
Payment is required before the Service is provided, unless agreed otherwise. In case of late payment, the Service may be cancelled and any paid deposit will not get refunded.
In case no payment is received within 5 (five) days of the due date, a late payment fee may be charged of the sum of $50 per day for each day payment is not received.

Purchasing a self-guided service

Purchases of the self-guided Service are handled by a third-party (SendOwl). After making a purchase, you will receive a confirmation email with instructions and your unique game code.

Make sure you check your junk folder for the booking confirmation email.

Follow the instructions from the confirmation email. A maximum of 6 participants can use 1 game code.

Hardware & software requirements

To use the Experios Services, each participant will need to have access to a computer with internet access (online services) or a modern smartphone with internet access (outdoor services) and the following:

  •  Access to our online portal and related websites without any firewall blocking access
  •  PDF viewer to open PDF files
  • Up-to-date anti-virus software
  •  Video app, to communicate with other team members (Zoom for hosted versions)
  •  Google Chrome or Microsoft Edge browser
  •  QR Code scanner
  •  A modern and fully charged smartphone with iOS 10+ or Android 8+ and an internet connection (outdoor services)

Outdoor: safe and appropriate behaviour

While you are using our Services, please be aware of your surroundings, and play and communicate safely. You agree that your use of the Services is at your own risk, and that you will not use the Services to violate any applicable law, regulation, policies, or instructions as outlined in these Terms and you will not encourage or enable any other individual to do so.
You agree that in conjunction with your use of the Services you will not make available any unlawful or inappropriate content and you agree that you will not submit inaccurate, misleading, or inappropriate remarks, including data submissions, edits, or removal requests.

Outdoor: weather conditions

Experios’ Services are played outdoors and are subject to weather conditions. Always check the weather forecasts and local conditions before starting the Service.
Experios does not provide a refund in case the Service could not be used due to weather conditions.
Once the Service has started, it can’t be paused, stopped or restarted.

Outdoor: road closures & limited access

Experios’ Services are played outdoors and there can be instances where certain areas or roads are not accessible.
In these cases, please notify us immediately and DO NOT attempt to gain access to areas or roads that are closed.
Always follow local rules and regulations, even if that means you cannot use the Service to the full extent.

Outdoor: interaction with your surroundings

You agree that in conjunction with your use of the Services, you will maintain safe and appropriate contact with other players and other people in the real world.

You will not harass threaten or otherwise violate the legal rights of others.
You will not trespass, or in any manner attempt to gain or gain access to any property or location where you do not have a right or permission to be.
You will not otherwise engage in any activity that may result in injury, death, property damage, nuisance, or liability of any kind.

If you have a dispute with any third party relating to your use of our Services, you release Experios (including our, directors, subsidiaries, joint ventures, and employees) from all claims, demands, and damages (actual and consequential) of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with such disputes.

Payment

All payments are processed by external parties. Payments are processed by Square, Stripe or PayPal. In case of any payment issues or disputes, contact the payment merchant. No credit card details are stored, unless with the customer’s explicit consent.

Refund policy

Experios does not provide any refunds for its Services.
In case you’ve made a booking and the date/time needs to be changed, the booking may be rescheduled at Experios’ courtesy and only if 3 days notice is provided.

In case you’re facing technology issues, Experios will try to help resolve the issue. Where the issue was caused by Experios, we provide a new game code once the issue has been resolved.
No refund will be provided.

Force majeur

Force majeure includes all unexpected events and problems, which reasonably are not to be expected and could not have been prevented. This includes, but is not limited to, third-party negligence, website outages, strikes, etc. Experios cannot be held accountable in these circumstances and does not provide a refund.

Pricing

All prices listed on our website are subject to change at any time. This includes sales, discounts and promotions.

Liability

To the extent permitted under applicable law, you agree that neither Experios nor any party associated with us, will be liable to you or any other participant for any direct, indirect, incidental, special, punitive, exemplary or consequential damages.

This includes lost profits, trauma, loss of data, hardware damage or system failure arising out of or in connection with these Terms.
You agree to communicate this exclusion of liability to any person that you invite to use an Experios Service.
At all times make sure you follow the instructions.
Any illegal, unlawful or wrongful conduct while using the Service should not be committed.

Confidentiality

You acknowledge that you will not publish, photograph, make copies of or otherwise expose the game content and answers. This includes both by word of mouth, on paper and online.

Data & privacy

All data collected is stored securely and will not be shared with any third-party, unless required to offer our Services. Experios reserves the right to collect data when offering our Service, including photos, videos and audio, and use them for promotional purposes. Where possible, we remove names, email addresses, phone numbers and other personal details.

IP & copyright

>Experios is the sole owner of the Service and its contents and owns the Intellectual Property rights. It is strictly forbidden to copy, distribute or resell any of the content. This includes but is not limited to: design, fonts, text, graphics, logos, icons, images, sounds, videos, data compilations, website layout, underlying code and software.

Using any of Experios’ contents publicly is not allowed, unless with permission. That includes using contents in reviews and news publications.

Your obligations

When purchasing and using our Services, you acknowledge that:

  • All participants are available at the booked date/time
  • All participants are able to travel to the game location (outdoor services)
  • All participants have the necessary hardware/software to use our Services
  •  All participants refrain from indecent behaviour (cursing, sending inappropriate pictures, choosing an offensive team name etc.)
  •  Experios, nor any other party, can be held responsible in any way for the use of the Service, including any damage that is a result of interactions between participants

Conduct

You agree that you are responsible for your own conduct and while using the Services, and for any consequences thereof.

Any attempt by you to disrupt or interfere with the Service is a breach of Experios’ Terms and may be a breach or violation of criminal and civil laws.
In addition, you agree not to do any of the following, unless applicable law mandates that you be given the right to do so:

  •  Use the Services or its content, or any portion thereof, for any commercial purpose or in a manner not permitted by these Terms
  •  Attempt to decipher, decompile, disassemble, or reverse engineer any of the software used to provide the Services or its content
  • All participants have the necessary hardware/software to use our Services
  • Bypass, remove, deactivate, descramble, or otherwise circumvent any technological measure implemented by Experios or any of Experios’ providers or any other third party (including another user) to protect the Services or its content
  • Violate any applicable law or regulation participants
  • Encourage or enable any other individual to do any of the foregoing

Under the age of 18

Experios recommends a minimum age of 18 to use our Services, unless stated otherwise. However, minors accompanied by adults are able to participate as well, under the full responsibility of the adult.

Breach of terms

In case you breach the Terms listed on this page, Experios reserves the right to cancel your booking, stop a game in progress or deactivate a game code without providing a refund.
